1. Definitions

In these Terms and Conditions:

• "Chiang Sala" / "we" / "us" / "our" refers to the senior living community operating at 88 Chalong Bay Road, Mueang Phuket, Phuket 83130, Thailand.
• "Service" refers to the membership programmes, residential arrangements, and website operated by Chiang Sala.
• "User" / "you" refers to any individual accessing our website or entering into a membership or residency arrangement with us.
• "Agreement" refers to these Terms and Conditions together with any specific membership or residency agreement entered into between us.
• "Content" refers to all text, images, and other material published on our website.

2. Acceptance of Terms

By using our website or entering into a membership or residency agreement with Chiang Sala, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept these Terms and Conditions in full. If you do not accept these terms, please do not use our website or services.

3. Service Description

Chiang Sala provides non-medical senior living arrangements in Phuket, Thailand, including:

• The Coastal Social Club — a monthly social membership programme.
• The Extended Stay Retreat — a short-to-medium term residential option.
• The Permanent Coastal Residence — a full-time residential arrangement.

Chiang Sala is not a medical facility, nursing home, or care home. We do not provide medical supervision, clinical care, or nursing services. Residents requiring medical support are responsible for arranging that independently.

Services are available to residents of any nationality subject to applicable Thai immigration requirements. We reserve the right to decline or terminate an arrangement if we determine it is not in the interest of the community.

4. User Responsibilities

In using our website and services, you agree to:

• Provide accurate and truthful information in contact forms and service agreements.
• Treat staff, other residents, and visitors with respect.
• Refrain from behaviour that disrupts the community or causes distress to others.
• Comply with applicable Thai laws and any house rules communicated at the time of agreement.
• Notify us promptly of any change in circumstances that may affect your arrangement.

Activities that are strictly prohibited include: damage to property, behaviour that poses a risk to the safety of others, and use of the community premises for commercial purposes without prior written agreement.

5. Intellectual Property

All content on the Chiang Sala website — including text, images, and design elements — is owned by or licensed to Chiang Sala. You are granted a limited, non-exclusive, non-transferable licence to access and view this content for personal, non-commercial purposes. Reproduction, redistribution, or commercial use of any content without prior written permission is prohibited.

6. Payment Terms

All pricing is quoted in Thai Baht (THB) and is inclusive of the services described in each arrangement. Payment terms for each arrangement are as follows:

• Coastal Social Club: Monthly in advance, due on or before the first day of each calendar month.
• Extended Stay Retreat: Full payment due at time of reservation confirmation, or as agreed in writing.
• Permanent Residence: Monthly in advance. A security deposit equivalent to one month's fee is required prior to move-in.

Accepted payment methods will be confirmed at the time of arrangement. Prices are subject to change with thirty days' written notice for ongoing arrangements.

7. Cancellation and Refunds

• Social Club: Cancellation with seven days' notice before the next billing cycle will prevent further charges. No refunds for the current month.
• Extended Stay: Cancellation more than fourteen days before arrival: full refund less an administrative fee of 1,000 THB. Cancellation within fourteen days of arrival: 50% refund.
• Permanent Residence: Sixty days' written notice required for termination. Security deposit returned within thirty days of departure, subject to inspection.

Chiang Sala reserves the right to terminate an arrangement in the event of a material breach of these terms, with notice provided where circumstances allow.

8. Disclaimers

Website content is provided for general information purposes and is subject to change without notice. While we endeavour to ensure accuracy, we make no representation that all content is complete or current at any given time. Chiang Sala does not provide medical, legal, or financial advice. No content on this website should be construed as such.

9. Limitation of Liability

To the extent permitted by Thai law, Chiang Sala's liability for any claim arising from these terms or from the provision of services is limited to the total fees paid by the claimant in the three months preceding the claim. We are not liable for indirect, consequential, or incidental losses, loss of profit, or loss of data. Nothing in these terms limits liability for death or personal injury caused by our negligence.

10. Indemnification

You agree to indemnify and hold harmless Chiang Sala, its staff, and associates from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your use of our website or services, or any misrepresentation made by you in connection with your arrangement.

11. Termination

Either party may terminate an arrangement in accordance with the notice terms set out in Section 7 above. Chiang Sala reserves the right to terminate access to the website or to decline future arrangements with any individual who has materially breached these terms. Upon termination of a residency, the resident agrees to vacate the premises within the period specified in their individual agreement.

12. Governing Law and Disputes

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these terms shall be subject to the jurisdiction of the courts of Phuket Province, Thailand. We encourage parties to seek informal resolution before initiating formal proceedings. Where mutually agreed, disputes may be referred to mediation.

13. General Provisions

• Entire agreement: These terms, together with any specific arrangement agreement, constitute the entire agreement between us.
• Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure to enforce any provision does not constitute waiver of future enforcement.
• Assignment: You may not assign your rights under these terms without our prior written consent.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. The "Last Updated" date at the top of this page will reflect any changes. Continued use of our website following an update constitutes acceptance. For material changes affecting active arrangements, we will provide thirty days' written notice.
